 Our Services

Workplace Mediation

Human interaction in the workplace can involve conflict between colleagues who have different personalities, viewpoints, and objectives.  If left ‘unchecked,’ conflict in the workplace can be harmful to people and organisations and contribute to strained working relationships, low productivity, and high employee turnover.

Workplace Mediation is suitable for resolving conflict when:

  • parties in dispute need to continue their working relationship;

  • one party feels uncomfortable with facing the other party alone;

  • parties are unable to resolve disputes alone, fairly or sustainably;

  • parties want to avoid using formal grievance procedures.

Workplace Mediation can transform working relationships and encourage people to:

  • talk openly, directly and respectfully to one another

  • take responsibility for their differences at work

  • get to the bottom of misunderstandings and assumptions;

  • iron out differences in what’s expected of each person;

  • re-establish boundaries and productivity; and

  • agree ways of working that are mutually beneficial.

Workplace mediation is proven to deliver better outcomes in working relationships and promotes open communication, respectful expression of perspectives and opinions, active listening, and a shared focus on achieving shared goals.

Commercial Mediation

Commercial mediation is widely used by business as an alternative dispute resolution (ADR) approach.  It provides a platform for parties involved in a commercial dispute to resolve their disagreement outside the traditional court system.

By facilitating open communication and mutual understanding, mediation can address the immediate conflict and underlying issues that are straining commercial relationships, taking up management time and focus, and disrupting operations.

In commercial mediation parties in dispute participate in a flexible, voluntary, and confidential process with a neutral mediator who assists them to reach a settlement agreement.  The mediator also facilitates dialogue to clarify the key issues, as well as negotiations and collaborative problem-solving that helps the parties to shape the outcome of their dispute.

Commercial mediation is suitable when:

  • commercial relationship are valued
  • poor communication and misunderstanding largely contribute to tensions in the dispute
  • parties want to retain control of the outcome to the dispute
  • confidentiality is important
  • speed is important to deliver a sensible and efficient outcome
  • complex and technical issues are involved

These are some of the circumstances that favour mediation and there are others that make mediation suitable and worthwhile.

The key benefits of commercial mediation include:

  • cost savings on legal fees, management time and energy
  • confidentiality
  • speed to set up a mediation and achieve resolution of disputes
  • an experienced, impartial mediator
  • sense of control and opportunity for creative, customised and mutually acceptable solutions preferable to a court-imposed judgment
  • preservation of ongoing commercial relationships
  • strong rates of settlements

Commercial mediation is proven to promote strong compliance with settlement agreements. It is however important for parties to ensure that they explore mediation at the appropriate time in order to make the best use of the process and its benefits.
